Steps to Take If You're Arrested in Miami
1. Remain Silent
You have the constitutional right to remain silent. Anything you say can and will be used against you in court. Politely inform officers that you wish to remain silent and want to speak to your lawyer.
2. Request an Attorney Immediately
Ask for your lawyer right away. Do not discuss your case with anyone else, especially law enforcement, without your attorney present. MVP Law has over 31 years of defense experience — reach out to us immediately.
3. Do Not Consent to Searches
You are not required to consent to a search of your person, car, or home. Refusing a search does not imply guilt. Stay calm and clearly state, "I do not consent to a search."
4. Don’t Resist Arrest
Even if the arrest is unjust, never resist. You can fight the charges in court. Resisting, even verbally, can add criminal charges and complicate your defense.
5. Document Everything
As soon as you’re able, write down or record everything you remember about the arrest — officers' names, badge numbers, time, place, and what was said or done. This can help your attorney build a stronger defense.
